The Steps of the K-1 Visa Process

Step 2: Receive Form I-797C (Notice of Action)

After submission, USCIS will send a receipt notice, Form I-797C, confirming they’ve received your petition. Processing usually takes 8-10 months, after which the petition is either approved or denied.

Step 3: Approval and Transfer to the National Visa Center (NVC)

Once approved, your case is sent to the National Visa Center, which assigns you a case number. The NVC then forwards your petition to the U.S. embassy or consulate in your fiancé(e)’s home country.

Step 4: File Form DS-160 (K-1 Visa Application)

Your fiancé(e) must complete Form DS-160 online, pay the $265 filing fee, and prepare for the visa interview. Be sure to save all confirmation documents for your records.

Step 5: Schedule the Visa Interview

The embassy will notify your fiancé(e) when to schedule their interview. They’ll need to complete a medical exam and bring all required documents, including proof of your relationship and confirmation of the DS-160.

Step 6: Visa Approval and U.S. Entry

If approved, your fiancé(e) will receive a visa stamp in their passport, allowing them to enter the U.S. within 4 months of issuance.

Step 7: Get Married Within 90 Days

Once your fiancé(e) arrives, you must get married within 90 days. If you fail to do so, they’ll need to leave the U.S. to avoid violating immigration laws.

Step 8: Apply for a Green Card

After marriage, your spouse can apply for permanent residency by filing Form I-485 (Adjustment of Status). If they want to work or travel during this time, they’ll also need to file Forms I-765 and I-131.
